Online Privacy Bill – Exposure Draft

AHISA’s submission addressed aspects of the Privacy Legislation Amendment (Enhancing Online Privacy and Other Measures) Bill 2021 (the Online Privacy Bill) relating to protections for young Australians.

While acknowledging the Australian Government’s intent to proactively engage online platform and service providers in the development of regulations for the industry, AHISA suggests that parameters of the proposed online provider Code be strengthened by adopting several recommendations from the 2020 report, Privacy risks and harms for children and other vulnerable groups in the online environment, published by the Office of the Australian Information Commissioner (OAIC).

Given the rapid evolution of digital environments, AHISA further recommends that the Bill be amended to include provision for biennial review of the impact of the Code by OAIC or the Office of the eSafety Commissioner.
